Controlling copyright created in the workplace

Employers aiming to secure ownership of works created by contractors need a signed engagement agreement specifying the assignment of copyright. The Federal Magistrate Court's ruling in "Centrestage Management Pty Ltd v Riedle" highlights the default position that copyright in original works created by hired independent contractors is owned by that individual. Employers should note that several factors can influence whether a worker is deemed a contractor or an employee under Australian law
